Recurring Payments Agreement
This Recurring Payments Agreement (the “Agreement”) governs automatic, recurring charges to your bank card or other payment method for Services provided by Akenai Host (“Akenai”, “we”, “us”, or “our”). By enabling recurring payments you agree to the terms below. This Agreement supplements the Terms of Service.
1. Definitions
1.1. Recurring payment — the automatic debit of funds from a bank card or other payment method on a regular schedule to pay for Services provided by Akenai.
1.2. Client — a natural or legal person that has entered into a service agreement with Akenai and consented to automatic charges.
2. Consent to Recurring Payments
2.1. By ordering Services with recurring billing enabled, the Client confirms consent to the automatic debit of funds from the linked bank card or payment method through Akenai’s payment processors.
2.2. The Client grants Akenai the right to charge the linked payment method on a regular basis for Services provided, in accordance with the chosen plan, until the subscription is cancelled.
2.3. Akenai will notify the Client in advance of each upcoming charge, generally at least 3 days before the renewal date.
3. Payment Terms
3.1. Recurring payments are processed in accordance with the plan and billing period selected by the Client at the time of order.
3.2. Akenai may change prices for Services on at least 30 (thirty) calendar days’ advance notice before the next charge.
3.3. If the Client’s payment method has insufficient funds, the charge may be retried automatically for up to 7 (seven) days. If the charge does not succeed within that period, the Service may be suspended in accordance with the Terms of Service.
4. Cancelling Recurring Payments
4.1. The Client may cancel recurring payments at any time through the Client Area on the Akenai website.
4.2. Cancellation takes effect for the next billing period. Any invoice already issued for the current period remains payable in full and the Service remains active until the end of that period.
5. Liability of the Parties
5.1. Akenai is not responsible for failed charges caused by incorrect payment-method data or insufficient funds.
5.2. The Client must keep their payment-method information up to date when it changes (new card number, new expiry date, etc.).
6. Other Provisions
6.1. Akenai may amend this Agreement unilaterally on prior notice to the Client.
6.2. Any disputes arising in connection with this Agreement will first be addressed through negotiation. If no resolution is reached, the dispute will be handled in accordance with applicable law as set out in the Terms of Service.
6.3. Use of the recurring-payment feature constitutes the Client’s full acceptance of this Agreement.
